[ EXECUTIVE ORDER NO. 96, September 18, 2025 ]

TRANSFERRING THE ATTACHMENT OF THE NATIONAL COMMISSION OF SENIOR CITIZENS TO THE DEPARTMENT OF SOCIAL WELFARE AND DEVELOPMENT, AND FOR OTHER PURPOSES

WHEREAS, Section 2 of Republic Act (RA) 11350 or the "National Commission of Senior Citizens (NCSC) Act" declares it a policy of the State to adopt measures that will advance the health and well-being of senior citizens, and implement various programs and services that will ensure a supportive and enabling environment for the elderly;

WHEREAS, Section 3 of RA No. 11350 established the NCSC under the Office of the President (OP), to ensure full implementation of laws, policies, and programs for the promotion and protection of the rights and well-being of senior citizens;

WHEREAS, Section 11 of RA No, 11350 provides that all functions, programs, projects and activities of the Department of Social Welfare and Development (DSWD) for the formulation, implementation and coordination of social welfare and development policies and programs for the poor, vulnerable, and disadvantaged senior citizens shall be transferred to NCSC;

WHEREAS, Section 5 of RA 9994 or the "Expanded Senior Citizen Act of 2010," as amended, established the Social Pension for Indigent Senior Citizens (SPISC) Program to provide monetary grant to eligible senior citizens to support their daily subsistence and medical needs;

WHEREAS, under Section 5 of RA No. 11916, the implementation, distribution, and management of the SPISC Program shall be transferred from DSWD to NCSC within a period not exceeding three (3) years from the effectivity of the said law;

WHEREAS, Section 3, Chapter 1, Title XVI, Book of Executive Order (EO) No. 292 or the "Administrative Code of 1987" mandates the DSWD to, among others, formulate, develop, and implement plans, programs, and projects in the field of social welfare and development, and coordinate all activities pertaining to the implementation of programs and services for the disabled, the aging, and other socially disadvantaged;

WHEREAS, pursuant to the Administration's Eight (8)-Point Socioeconomic Agenda, which includes improving bureaucratic efficiency, a strong organizational link between the NCSC and DSWD must be established to further strengthen policies and programs for senior citizens, with the goal of enhancing delivery of social services and promoting the overall well-being and protection of the elderly;

WHEREAS, under Section 31, Chapter 10, Title III of EO No. 292, the President, in order to achieve simplicity, economy, and efficiency, shall have the continuing authority to recognize the administrative structure of the OP, and for this purpose, may transfer any agency under the OP to any other department or agency;

WHEREAS, Section 6(3) of RA No. 12231 or the "Government Optimization ACT" authorizes the President to transfer or integrate functions from one (1) agency to another which can better perform the same, or split functions from one (1) agency to another which can better perform the same, or split functions of agencies, bureaus, and offices that may be conflicting or multifarious; and

WHEREAS, Section 17, Article VII of the Constitution vests in the President the power of control over all Executive departments, bureaus, and offices;

NOW THEREFORE, I, FERDINAND R, MARCOS, JR., President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, do hereby order:

Section 1. Attachment. The NCSC is hereby attached to DSWD for purposes of policy and program coordination.ℒαwρhi৷

Section 2. Implementation of the SPISC Program. The implementation, distribution, and management of the SPISC program shall continue to be under the DSWD. For this purpose, DSWD may seek the assistance of the NCSC to ensure the successful implementation of said Program.

Section 3. Separability. If any part of this Order is held invalid or unconstitutional, the provisions not affected thereby shall remain in full force and effect.

Section 4. Repeal. All orders, rules and regulations, and other issuances or parts thereof which are inconsistent with the provisions of this Order, are hereby repealed or modified accordingly.

Section 5. Effectivity. This Order shall take effect immediately.
